This Privacy Policy describes how MODI SARVESHWAR TECHNOLOGIES PRIVATE LIMITED (“MSgames”, “we”, “us” or “our”) collects, uses, stores, discloses and processes personal data when you access the website available at https://msgames.in (“Website”) or use any simulation games, AI-enabled learning tools, dashboards, downloadable materials or related services provided by MSgames (“Platform”). By accessing or using the Platform, you acknowledge and consent to the practices described in this Privacy Policy. If you do not agree with this Policy, you must discontinue use of the Platform.

This Privacy Policy applies to individuals who access the Platform directly (“Individual Users”) as well as users who access the Platform through an educational institution, employer or other organisation (“Institution”).

1. Definitions

For the purposes of this Privacy Policy:

“Personal Data” refers to any data about an individual who is identifiable by or in relation to such data.

“Processing” includes storing, collecting, organising, using, disclosing or otherwise handling Personal Data.

“Institution” means any university, college, school, corporate employer, training provider or organisation that provides authorised access to the Platform for its learners, employees or participants.

“AI Content” means any content generated by MSgames’ AI-enabled features in response to user inputs, prompts or gameplay actions.

“User Content” means any files, text, uploads, submissions, comments or other materials provided by a User through the Platform.

2. Personal Data We Collect

2.1 Identity and Contact Data

We may collect your name, email address (including personal, institutional or work email), the name of your Institution or employer, and your role (including student, faculty, administrator, corporate learner or individual learner).

2.2 Account and Access Data

We collect login credentials, session identifiers, user authorisations, access timestamps and other information used to authenticate and administer your account.

2.3 Simulation and Gameplay Data

When you interact with simulations or learning tools, we collect data regarding your choices, actions, progress, attempts, responses, performance, scores, time spent, behavioural paths and leaderboard results.

2.4 AI Interaction Data

When you engage with AI-enabled hints or contextual support, we process your inputs, prompts, related contextual data, the resulting AI Content and metadata such as user ID, session ID and, if applicable, Institution ID.

2.5 Technical and Usage Data

We may automatically collect technical information such as IP address, browser type, device type, operating system, usage logs, diagnostic information, cookies and tracking identifiers.

2.6 User-Submitted Content

We may process any files, comments, responses, feedback or other User Content you submit through the Platform.

2.7 Sensitive Personal Data

MSgames does not intentionally collect sensitive personal data such as financial information, biometric identifiers, health data or government-issued identification numbers. If such data is voluntarily provided, we will process it only to the extent necessary and in accordance with applicable law.

2.8 Children’s Data

MSgames does not knowingly allow minors to create accounts or independently access paid services. Where minors access the Platform through an Institution, the Institution is solely responsible for obtaining any necessary parental or guardian consent under applicable law. MSgames relies on the Institution for such compliance.

3. Accuracy of Personal Data

Users are responsible for ensuring that the Personal Data they provide is accurate, complete and up to date. MSgames may rely on the accuracy of such information until notified otherwise.

4. Purposes for Processing Personal Data

We process Personal Data for the following purposes:

(a) providing access to the Platform and its features;
(b) operating simulations, generating AI-enabled hints and supporting gameplay;
(c) administering accounts and authenticating users;
(d) generating reports, dashboards, analytics and performance insights;
(e) supporting Institutions in academic, training or administrative activities;
(f) managing security, preventing misuse and enforcing academic integrity;
(g) complying with legal and regulatory requirements;
(h) responding to enquiries and providing technical support; and
(i) improving the Platform, including through aggregated or anonymised data analytics.

5. No Automated Decision-Making

MSgames does not use Personal Data to make automated decisions that produce legal or significant effects on a User. AI-enabled features provide contextual hints or support solely for educational or training purposes and do not determine grades, certification, employment outcomes or eligibility for academic or professional decisions.

6. Lawful Basis for Processing

We process Personal Data on one or more of the following grounds:
(a) performance of a contract or provision of services;
(b) fulfilment of Institutional requirements pursuant to lawful arrangements;
(c) compliance with legal obligations;
(d) explicit consent, where required; and
(e) legitimate interests, including Platform improvement, analytics, security and fraud prevention, provided such interests do not override your rights.

7. Disclosure of Personal Data

7.1 Disclosure to Institutions

If you access the Platform through an Institution, we may disclose your gameplay data, analytics, AI Content and other relevant information to authorised faculty members, administrators or representatives of the Institution. Once disclosed, the Institution becomes an independent Data Fiduciary responsible for its own processing of such data.

7.2 Disclosure to Service Providers

We may share Personal Data with third-party service providers engaged for cloud hosting, infrastructure management, analytics, AI processing, security, payment processing and email services. These providers act under strict contractual obligations to maintain confidentiality, process Personal Data only on MSgames’ instructions and implement reasonable security safeguards.

7.3 Legal Disclosures

We may disclose Personal Data to law enforcement agencies, government authorities, courts or regulatory bodies where required by applicable law or in response to lawful requests.

7.4 Business Transfers

If MSgames undergoes a merger, acquisition, restructuring or similar transaction, Personal Data may be transferred to the relevant successor entity subject to comparable safeguards.

8. Links to Third-Party Websites

The Platform may contain links to third-party websites or resources. MSgames is not responsible for the content, privacy practices or security of such external websites. Access to third-party sites is at your own risk and subject to the terms and privacy policies of those websites.

10. Data Retention

We retain Personal Data only for as long as necessary to fulfil the purposes for which it was collected, to comply with legal or contractual obligations or to resolve disputes. Anonymised or aggregated data may be retained for analytics and product development. Withdrawal of consent or deletion requests may impact access to certain Platform features.

We implement reasonable administrative, technical and organisational safeguards to protect Personal Data from unauthorised access, alteration, disclosure or destruction. These include encryption, access controls, secure cloud storage, logging and monitoring.

MSgames shall not be liable for any loss, damage or unauthorised disclosure of Personal Data resulting from events beyond its reasonable control, including cyber-attacks, power outages, third-party service failures, natural disasters or other force majeure events.

12. Your Rights

Subject to applicable law, you may request access to your Personal Data, seek correction of inaccurate or incomplete data, request erasure or withdrawal of consent (where applicable), or submit grievances. Certain rights may be restricted where processing is necessary for legal, contractual or Institutional obligations.

13. International Data Transfers

Personal Data may be processed or stored using global cloud service providers. Such transfers occur with appropriate contractual and technical safeguards to ensure protection consistent with applicable law.

14. Governing Law and Jurisdiction

This Privacy Policy shall be governed by, and construed in accordance with, the laws of India. Any disputes arising out of or relating to this Policy shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra.

15. Changes to This Privacy Policy

MSgames may update or modify this Privacy Policy from time to time. The updated version will be posted on the Website with a revised Effective Date. Continued use of the Platform constitutes acceptance of the updated Policy.
