Last Updated: 22.12.2025

These Terms of Use (“Terms”) govern your access to and use of the website located at https://msgames.in (“Website”), the simulation games, AI-enabled features, dashboards, downloadable content, documents, and related services offered by MODI SARVESHWAR TECHNOLOGIES PRIVATE LIMITED (“MSgames”, “we”, “us”, or “our”). By accessing MSgames, you (“User”, “you”) agree to these Terms. If you do not agree, do not use the Platform.

These Terms apply to both Individual Users and Institutional Users (those accessing MSgames through an educational institution, employer, or training organisation).

1. Eligibility

You must be at least 18 years old and legally competent to enter into a binding contract. Where minors access MSgames through an Institution, the Institution confirms that parental or guardian consent has been obtained in accordance with applicable laws. MSgames processes such data only for educational or training purposes as requested by the Institution. MSgames does not knowingly allow minors to independently register or purchase services.

2. Account Registration

Access to certain features may require account registration or receipt of credentials issued by MSgames or your Institution. You must maintain accurate account information and ensure the confidentiality of your login credentials. You are responsible for all activity under your account. MSgames may suspend or terminate access in cases of violation of the Terms, misuse, illegal activity, security risks, non-payment, or institutional directives.

3. Services Offered

MSgames provides browser-based simulations, experiential learning tools, AI-generated hints, contextual feedback, dashboards, leaderboards, analytics, downloadable materials, and institutional reporting tools. Some features may require payment or specific authorisation from your Institution.

4. Licence to Use

MSgames grants you a limited, non-exclusive, non-transferable and revocable licence to use the Platform for personal learning or institutional training. You agree not to copy, reproduce, reverse-engineer, modify, distribute, or publish any part of MSgames; bypass security systems; scrape or automate access; interfere with gameplay integrity; or use the Platform for unlawful or harmful purposes.

5. User-Generated Content

“User Content” includes your simulation decisions, inputs, text entries, uploads, comments, posts, and other materials.
You retain ownership of your User Content but grant MSgames a worldwide, perpetual and royalty-free licence to store and process it, display it within the Platform, generate analytics, improve MSgames systems, and share it with your Institution (for Institutional Users).
You confirm that your User Content does not infringe third-party rights, violate confidentiality obligations, or include unlawful, harmful, or inappropriate material. MSgames may remove User Content at its discretion.

6. AI-Generated Content and Hints

Certain simulations include AI-generated feedback, hints, explanations or adaptive messages (“AI Content”). AI Content may be stored and linked to your account ID, simulation session ID, Institution ID (for Institutional Users), and pseudonymous identifiers.

For Institutional Users, gameplay data, behaviour analytics and AI Content may be shared with authorised faculty or administrators. For Individual Users, MSgames does not share such content with external parties except essential service providers.
AI Content is used solely to provide simulation services, improve system performance, debug issues, ensure academic integrity, and generate institutional analytics.
AI Content may be incorrect, incomplete or non-deterministic. It is provided only for educational purposes and should not be relied upon for real-world or professional decisions. MSgames disclaims liability for reliance on AI outputs.

7. Payments and Refunds

Individual Users may purchase simulations or licences. Institutions may purchase group access on behalf of learners. Payments are processed by third-party processors, and MSgames does not store payment card details.
All purchases are non-refundable except where required under consumer protection law or where MSgames determines that a User could not access the service due to a technical fault solely attributable to MSgames. Applicable taxes may be charged in addition.

8. Third-Party Service Providers

MSgames uses third-party providers for hosting, analytics, AI processing, payment processing, LMS integrations, email delivery, monitoring, and security. Providers may change over time.
Each provider is contractually obligated to implement security safeguards, process data only on MSgames' instructions, and maintain confidentiality.

9. Prohibited Conduct

Users must not attack, hack or disrupt MSgames; upload harmful code; impersonate others; violate intellectual property rights; manipulate gameplay outcomes; misuse AI Content; or engage in any illegal or harmful activity.

10. Intellectual Property

MSgames owns all rights in its simulations, content, design elements, datasets, software, and materials. You may not copy, publish, distribute or exploit MSgames content without written permission. Any feedback you provide may be used by MSgames without restriction.

11. Data Protection and Privacy

MSgames processes personal data in accordance with its Privacy Policy, which forms part of these Terms. MSgames processes data under the lawful bases of performance of contract, provision of educational services, compliance with legal obligations, and consent where applicable.
Reasonable safeguards are implemented to protect personal data. Users may request access, correction, erasure (subject to institutional or legal restrictions), or raise grievances.
Institutions act as independent Data Fiduciaries for learner data they access, download or export. MSgames is not responsible for institutional misuse of exported data.

12. Reports, Analytics and Exports

Institutions may view, download or export learner data, performance analytics and AI Content as permitted by the Institution Agreement. Once exported, the Institution is solely responsible for security, confidentiality and compliance.
Individual Users may view their own performance reports; download features may be introduced later.

13. Simulation Limitations

Simulations are simplified representations of real-world scenarios. MSgames does not guarantee the accuracy, completeness or predictive validity of outcomes and disclaims liability for reliance on simulation results.

14. Disclaimers

The Platform is provided on an “as is” and “as available” basis. MSgames does not guarantee uninterrupted service, error-free functioning, accuracy of AI Content, continued availability of features, or academic or professional results.
MSgames is not responsible for third-party failures, institutional grading or evaluation decisions, or reliance on simulation or AI content.

15. Limitation of Liability

To the extent permitted by law, MSgames is not liable for indirect, incidental, punitive or consequential damages.
MSgames’ total liability is limited to:
• for Individual Users: the amount paid in the three months preceding the incident or INR 5,000, whichever is lower;
• for Institutions: the amounts payable under the applicable Institution Agreement.

16. Termination

MSgames may suspend or terminate access in cases of breach of Terms, misuse, institutional directives, security concerns or non-payment. Clauses relating to intellectual property, limitation of liability, disclaimers and governing law continue to apply after termination.

17. Governing Law and Jurisdiction

These Terms are governed by Indian law. All disputes are subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.

18. Modifications

MSgames may update these Terms at any time. Continued use of the Platform constitutes acceptance of the updated Terms.

19. Grievance Officer

In accordance with applicable Indian law:

Email: contact@msgames.in

Users may contact the Grievance Officer for data-related concerns.

20. General

If any provision of these Terms is found invalid, the remainder shall remain in effect. Failure to enforce any right does not constitute a waiver. Users may not assign their rights. MSgames may assign rights to affiliates or successor entities.
